Lottery millionaire Michael Carroll has been granted legal aid to fight a court case next week, it emerged today.

The Department for Constitutional Affairs today confirmed that Carroll, who scooped a £9.7 million National Lottery jackpot in 2002, had been granted court funding.

He faces a charge of affray and is due to stand trial at Norwich Crown Court on Monday.

A Legal Services Commission spokesman said:

"Michael Carroll is currently receiving criminal legal aid. However, in a Crown Court case, the judge can order a defendant who is found guilty to repay all their legal costs following an assessment by the LSC.

"At the request of the Crown Court, the Legal Services Commission is carrying out a review of the financial circumstances of Michael Carroll. Once a review is complete, a report will be submitted to the Crown Court for their consideration.

"A means test for receiving legal aid in criminal cases is due to be introduced this year, as part of the Criminal Defence Service Bill, which is currently before Parliament. This means testing will ensure that those who can afford to pay for their own legal defence do so. The criminal legal aid means test will first be rolled out in Magistrates Court and then Crown Court."
