Question about Constitutions

If a Community group has a Constitution but completely ignores that Constitution, how does that affect things like insurance, bank accounts and future funding etc? I'm presuming that there are legal issues here as each one (insurance, banking, funding) all insist on seeing your constitution before committing to any arrangement.
