My son gave his employers notice on 28th August, one month as per the terms of his contract. On 13th September they put him and five other employees on notice on 'garden leave'. The confirmation letter states that any unused holiday entitlement will be used up by the gardening leave. when he asked for clarification they stated their 'rules' allow it, as follows.

 

 

following your resignation we took the decision to place you on garden leave. The company reserves the right to determine when annual leave is taken and, as confirmed, the decision was made for you to take part of your accrued annual leave during this period. When on annual leave, the rules specifically relating to garden leave do not apply, details of which are in the letter given to you last week (a copy of which is attached).Any remaining accrued annual leave will be paid in your final salary at the end of September.

 

Is this legal, oh sages of the forum?
