DJS Posted January 6, 2016 Posted January 6, 2016 I had some guy on a motorbike go into the back of my car while i was stationary. We both waited at the scene, and i took his details.During this conversation, he admitted that he was to blame for the incident. He also told me to call him later when he was at home, because he didnt have his insurance policy number on him at the time. My insurance company said i can make a claim via my policy & i would have to pay my excess, but this could be recovered from his insurance company & reimbursed to me PROVIDING i can prove that he was to blame or he admits it himself. When i rang him to take his policy number, i asked him if he still acknowledges that the accident was his fault and he said yes - I recorded the whole telephone call, so i have a recording of him accepting blame. Hopefully he will not deny blame when the insurance company discusses it with him, but if he does deny it - can i legally use the recording as evidence? I did not tell him that i was recording the call. Anyone have any definitive thoughts on this? Thanks.
