employment law advice needed (as an employer)

some lad that used to work for us signed off sick for about 4 months with depression

 

now he wants to come back but I don't want him back as he is not fit to work

 

 

what do I do?

 

if you're going to advise me, please assume that he is indeed NOT fit to work but that fact has not been picked up by his doctor so the sick note will run its course and he'll turn up expecting his job back
