insurance claim question

My sister had an accident while driving my mother's car, the accident wasn't her fault (there's a witness statment that backs that)

 

the complication is that my sister is insured on another car as a main driver, so she's only insured for third party on my mother's car, the other guy is not accepting liability, my sister's insurance company are saying that they can't get involved as the other guy isn't making a claim, and the other guy's insurance company seem to be backing their client despite the evidence, and they're refusing to cooperate further

 

The car is still drivable, but it's still in need of repair, how should we pursue this further?
