According to the Beeb and SSN and the Prmier league - until it's West ham who can demonstrate their true ownership by reclaiming the vast bulk of any transfer fee - so that's that then! West Ham are currently in a court case with Kia Joorbachian over the destination of any such fiunds, should a sale arise.

West Ham hold his registration according to the Premier League - hence why they allowed him to play those games at the end of the season. West Ham say he's under a 3yr contract to them - so now they agree to loan him to United for 2 years to get him back when he'll only have 1 year left on that contract and wont command any decent fee?

From a WHU fans forum

 

 

Tevez's original contract included a clause that allowed Kia to sell him during any transfer window without West Ham's permission.

 

This was deemed illegal by the PL's disciplinary inquiry.

 

West Ham tore up that contract and handed a new one to Kia and Tevez which DID NOT include that contract.

 

Kia and Tevez refused to sign it but, according to West Ham and the PL, that didn't matter.

 

Kia apparently has some more damning evidence against Brown and Aldridge (and therefore West Ham) which he threatened to hand to the disciplinary inquiry and then the arbitration panel if Eggy didn't allow him to sell Tevez. He made damn sure everyone knew about it by feeding these tales to the Daily Mail.

 

Eggy was left in an impossible position - he had to say publicly that Tevez was outs while provately allowing Kia to hawk him around. Eggy did offer to beat any bid made by another club but Kia and Tevez weren't interested.

 

So the disciplinary inquiry comes and goes and West Ham survive. The arbitration panel comes and goes and West Ham survive.

 

Then Kia announces via the media that Tevez will be joining ManU. Eggy knew nothing of this deal and is understandably angry having been promised by Kia West Ham would be allowed to beat any deal offered elsewhere.

 

The PL step in and say any transfer fees MUST be paid to West Ham and not Kia as the contract filed with the PL clearly shows West Ham to be Tevez's owner for the next 3 years.

 

So where do we go from here?

 

If West Ham are to work within PL rules and escape further punishment then any transfer fee MUST be paid to us, not Kia.

 

But Kia is equally determined he alone will receive all monies.

 

Our saving grace in all this would seem to be that going to court - which would seem the obvious conclusion - will be terrible for all parties involved.

 

West Ham would be dragged back into the "illegal contract" row, Kia would become a pariah in English football and he might even lose his rights to be a worldwide agent.

 

So I can only see one outcome - West Ham, Kia and ManU reach an agreement in which all fees are paid to West Ham and then passed on (minus £5.5m to cover the fine) to Kia for "commercial duties".

 

This cannot end quick enough...

Tevez's £30m United move puts pressure on Hammers for answers

Carlos Tevez is set to sign for Manchester United in the next two days in a deal that could be worth up to £30m. The Argentine will fly directly from the Copa America in Venezuela to join up with United's pre-season tour to the United States on Monday.

 

However the transfer could lead to a round of legal action with his present club, West Ham United, fearing they will be urged by the Premier League to clarify Tevez's registration and ownership by taking Kia Joorabchian, the businessman who owns his economic rights, to court.

 

In the light of the highly-sensitive inquiry into Tevez's transfer to Upton Park, West Ham would clearly not want to take that step. There are concerns at the club as to exactly how they can now extricate themselves from the saga without hurt being caused especially as Joorabchian could present potentially damaging evidence against them in court.

 

Tevez will sign a two-year deal at United with a "loan fee" of between £4m-£8m a year being paid. None of that will go to West Ham, even though they hold his registration and claim that he is "their player". Instead the money will be received by Joorabchian and the companies that control Tevez. United will then have an "exclusive option" in the second year of buying the striker out-right. That fee is expected to be between £14m-£22m.

 

When Tevez signs for United the Premiership champions will hold his registration. However Joorabchian will still retain the 23-year-old's "ownership and economic rights" until a permanent deal is agreed.

 

Although controversial it does not break the Premier League rules which allow for third-party ownership of players but which preclude the existence of so-called "side agreements" which allow that third-party influence over the club.

 

United are annoyed that news of Tevez's transfer has leaked - it was blurted out by the player to Fox TV in South America on Thursday - but the revelation does not jeopardises the deal.

 

Interest in Tevez has been shown by Chelsea, Real Madrid, Liverpool and Internazionale. But it is United who have made their move adding to the £50m spending spree they have already embarked on this summer as they build on last season's successes.

 

Tevez's departure will come as a relief to the West Ham hierarchy even if they know they are losing an outstanding player. The last thing they will now want is for the circumstances surrounding the deal to be pored over once more, especially in court. But that may be unavoidable if the Premier League decide to raise objections.

He's still owned by Kia Ora.

Wish Rafa would have made him a serious target and beat out the Mancs. I think he is going to be even better next season and this will be a great signing for the Mancs :(

West Ham have cheated the system and got away with it.

 

 

With the help of the PL administrators. They cokcked up in letting it pass in the first place. They told West Ham to call MSI's bluff, and they'd back them. Money goes to MSI ot there is real court for breach of contract. West Ham have never bought the player.

yup, have to agree..

 

getting sick of all the smart comments today in work from mancs about them getting the better player between Torres and Tevez etc etc... it seems Redcafe probably does sum up the average manc fan.

hopefully itll work out....last time i was truly excited by a signing was Veron...i learnt my lesson then.

 

I'll just wait and see how it works out for the guy and team.

Is there actually anyone in football who has the remotest idea who owns Tevez and Mascherano and what type of deal setup it is? It just seems to be one huge mess tha tcan't quite be unravelled.

total joke it is

 

FIFA/UEFA/FA need to step in and sort out clear rules about player ownership, the idea that an individual can own a players 'economic' rights :wacko: and loan him here there and everywhere is farcical.

 

If it means we lose Mascherano in the process so be it

The sports arbitration report suggests we have him on loan - similar deal to that which West Ham had except the third party can't force the sale of the player.

 

Report. Page 5 details the dodgy third party agreement. Page 29 details what went on in January with regards to the delay with Mascherano's registration for Liverpool.
