  1. Right - again - it's not my opinion. The legal case has to be dealt with in the UK by the terms of the agreement between all parties, including H&G. The fact that the High court has ruled in favour of the board twice in as many days sets this as binding according to international law specialists through various outlets today.
  2. He has to go through procedure 9and is no doubt enjoying his 15 mikns as he's up for re-election), but the findings in London are binding - it's how it works - all the International Law specialists the various media outlets lined up confirmed this.

  5. Whether they disagree is irrelevant - it's the legal postion as recognised internationaly that the jurisdiction rests in the UK for this case.
  6. Zilch - the court here has already ruled in the boards favour and that Hicks broke the contracts entered into. A US civil suit ishis best option and stands little chance of success.

  15. They could, if they wanted to, complete now, this minute - done, no comeback on that level. However...as NESV are US residents* and RBS do plenty of buiness in texas they wish to do it by the numbers - get it lifted if poss, or just go after the 4pm deadline anyway when H&G will be in contempt if it is still in place. That's where we are as of now. *One US commercial lawyer said being based for residential and business purposes in the commonwealth of Massachusetts (opposite end and side of the country to Texas), NESV probably wouldn't be held to the ruling either.
  16. It really doesn't. As from 4pm tomorrow unless something stunning happens - mainly Hicks paying back RBS in cash - it's over and he'll have to try and sue for damages. Not my opinion - but that of several leading commercial and international company lawyers quoted a few pages back in the thread after the verdict today.

Oddly enough, the meeting of the board (which he and Gillett attended via vidconf) is what they're referring to - the one at 8.pm or so last night after the initial HC judgement ruled the sale legal. Hicks took out his injunction ahead of that meeting and has therefore claimed that meeting was in 'contempt' - it's totally laughable and won't stand and in fact, hasn't.

  19. Nah - it was earlier today and was kiboshed by Justice Floyd who said Juristiction rests here in the UK and has nothing to do with texas. He then issue a counter injunction and they (H&G) will be in contempt as from$pm tomorrow (GMT) if they don't lift the TRO or our people don't have it thrown out first, which they are apaprently in the process of doing in a Dallas court right now.

  24. It's not inconceivable he's acting alone to put distance beyween himself and Hicks. maybe their marriage of convenience is slightly less convenient after the last two days.
